The State of Illinois requires each employer who 1) does business in the State of Illinois and 2) participates in E-Verify to complete an E-Verify Attestation Form. Section 12(b) of the Right to Privacy in the Workplace Act, 820 ILCS 55, requires employers to attest that they have familiarized themselves with the protocols of the E-VErify system. Even employers who access E-VErify through Designated Agents must complete the form. The attestation must be maintained in the employers records for submission to the Illinois Department of Labor upon request.
